第五编第二章“法律责任分则”第十二节、第十三节，考虑到生态保护、绿色低碳发展方面其他相关法律继续适用，多数法律责任在其他法律中已有规定，对违反生态保护管理规定的行为和违反绿色低碳发展管理规定的行为，采取具体规定和指引规定相结合的方式，规定了行政处罚责任。一是承接海洋环境保护法、清洁生产促进法中法律责任规定。这两部法律在法典通过后将废止，对其中涉及海洋生态环境保护、绿色低碳发展的法律责任，在草案中明确规定。比如，对于占用、损害自然岸线行为，不实施强制性清洁生产审核或者在清洁生产审核中弄虚作假等行为，规定具体的行政处罚责任（草案第一千二百一十七条、第一千二百二十二条）。二是针对生态保护、绿色低碳发展领域突出问题，回应实践需求，填补法律责任空白。比如，对未按照生态环境准入清单进行生产建设活动，未经批准擅自取用地下水，未按照规定建立废旧产品回收体系，未遵守一次性塑料制品生产销售使用规定，纳入全国碳排放权交易市场的温室气体重点排放单位未报送排放统计核算数据或者年度排放报告等行为，规定了具体的行政处罚责任（草案第一千二百一十八条、第一千二百一十九条、第一千二百二十四条、第一千二百二十六条、第一千二百二十七条）。三是作出衔接性、指引性规定。明确违反本法有关生态保护、绿色低碳义务，本法未规定行政处罚的，依照有关法律法规的规定予以处罚（草案第一千二百二十条、第一千二百二十八条）。

Daron Hall is the antithesis of the stereotypical Southern sheriff: he doesn’t like guns and it’s nearly impossible to find a photograph of him in uniform. He prefers to present his six-foot-four frame—he was a kicker on his college football team—in well-tailored suits. With his open, often smiling face, white goatee, receding hairline, and glasses, Hall looks more like a politician than a sheriff. Now sixty-one, he has been in the position longer than anyone else in Davidson County history, and he inspires fierce loyalty in his staff, many of whom have been with him since his first election. They trust Hall for the same reason that Friedmann’s admirers trusted Friedmann—Hall is devoted to his work and very good at it.
